American Nurses Association - (ANA)
The American Nurses Association (ANA) develop standards for nursing practice, the code of ethics for
nurses, and policy statements. For example, the scope of nursing and 17
standards of practice that describe what nurses do are published. Sometimes they are used when legal actions are taken against nurses.
The Joint Commission (TJC)
requires written nursing policies and procedures that are accessible on all nursing units. Agency
policies and procedures must conform to state and federal laws and community standards.
Negligance
conduct falls below standard of care - include act of commission OR omission.
Malpractice
negligence on part of the nurse - nurse had duty of care (NPA) and duty breached (nursing regulations) and client injured due to failure to perform duty.
Standard of Proof
what prudent nurse would do under similar circumstances in area where breach occurred. degree to which evidence must show duty of care was violated resulting in harm to patient. During a malpractice suit, a nurse’s actual conduct is compared with
nursing standards of care to determine whether the nurse acted as any reasonably
prudent nurse would act under the same or similar circumstances.
