Promissory Estoppel (CL) elements
- A promisor makes a promise with the reasonable expectation that the promise will rely on it
- promisee reasonably relies on the promise
- Promisee incurs a detriment as a result

The same elements as promissory estoppel
Reliance (Restatement 90) Remedy
the amount lost as a result of the reliance (out of pocket loss)
Moral Obligation (CL)
In extreme circumstances a promise made in recognition of a past benefit will be binding despite the absence of consideration
Moral Obligation, past consideration
a benefit conferred or a detriment suffered prior to the making of a promise (remember exceptions)
Moral Obligation elements
extreme benefit, extreme detriment, subsequent promise is made in response to the previously conferred benefit
Webb v. McGowin
Moral obligation is sufficient to support a subsequent promise to pay where the promisor has received a material and substantial benefit
Quasi- Contracts (restatement 86 version of moral obligation) elements
promisor has previously received a non-gratuitous benefit from the promisee and promisor makes a promise in recognition of the benefit
Moral Obligation remedy
full enforcement of the promise
Quasi-contract remedy
the promise is binding to the extent necessary to prevent injustice
Unjust enrichment
Occurs when one person is economically enriched at the expense of another in circumstances that the law sees as unjust (the court will typically find an implied in law contract)
