What are the four types of licences available under this Act?
- on-licence - off-licence - club licence - special licence
What does an on-licence authorise? Section 14
- sell - supply - allow the consumption of alcohol ON THE PREMISES or conveyance described on the licence
What does an off-licence authorise? Section 17
- sell - deliver - arrange for delivery of alcohol for consumption OFF THE PREMISES described in the licence
What does a club licence authorise? Section 21
- Sell - supply alcohol for consumption ON THE PREMISES described in the licence to any: - member - guest accompanied by member - member of another club with reciprocal visiting rights
What does a special licence authorise? Section 22
On site: - sell - supply alcohol for consumption ON THE PREMISES to any - person attending any occasions or events described in the licence Off site: - sell alcohol for consumption ELSEWHERE to any - person attending any occasions or events described in the licence
What are the conditions around displaying of licences and duty managers?
It must be displayed at all times in the interior The duty managers name must be prominently displayed at all times too
What are the four intoxication indicators and how many indicators must be evident before a person can be considered intoxicated?
- Appearance - Behavior - Co-ordination - speech 2 must be evident
What are the elements of Section 244, Minors found in restricted or supervised area?
-Every person commits an offence who - being under 18 years - is found in any - restricted area or supervised area (unless supervised by parent/guardian) - on licenced premises. Can be seen entering or leaving, do not need to be found consuming, mere presence is enough. A person of ANY AGE may be in a supervised area if with parent/guardian
What is the definition of guardian?
A person who has permanent lawful custody. An older relative or friend would not qualify
What are the rules around employing minors?
Minors can sell and serve in supervised areas but not in restricted areas, the penalty is a fine of $2000
What are the elements of Section 243, Minors Purchasing Alcohol?
- Every person commits an offence who - Being under 18 - Purchases - Any alcohol on or from a licenced premises. I.d includes - passport (nz or overseas) - nz driver licence - an 18+ card (nz)
