Yes because as pilot in command it is your duty to take a safe route despite ATC clearance

The lower aircraft has right of way to land and the higher aircraft must take necessary action to avoid collision.
What is the 1000ft rule
No aircraft is allowed to fly over a congested area below 1000ft above the highest fixed obstacle and within a 600ft radius
What is the 500ft rule
No aircraft is allowed to fly over any person, vessel or structure less than 500ft above.

To the left and as soon as possible
