What is hearsay evidence?
Oral or written statement of someone who is not produced as a witness in court
What are the three types of evidence?
Hearsay
Opinion
Propensity

Can be admissible if the statement is reliable and either
- the person is unavailable
- it would cause undue expense or delay in obtaining the witness

Accuracy of the statement

What does H in chant mean?
How the statement was taken

What does N in chant mean?
Nature of the statement
First or second hand hearsay
What does T in chant mean?
Truthfulness of the maker of the statement
Motive to lie, nervous, demeanour
Section 16(2) unavailable as a witness

What does admission mean
Anything the defendant says
What does confession mean
Full statement admitting guilt
What is opinion evidence?
Is an inference from observed facts
