What is considered inconsiderate driving?
Slow driving and refuses to pull over
What is careless driving?
Eg, colliding with a parked vehicle or indicating one way and going the other
What is dangerous driving?
Driving in a manner or speed which may have been dangerous
What is reckless driving?
Knowingly disregarding ones duty as a safe driver or deliberately running an unjustifiable risk
What is section 113 of the land transport act?
DIRECT a person on the road to give you their full details. Must be driving unless have committed an offence.
INSPECT or test vehicle
MOVE the vehicle to ensure it’s safer
DIRECT another person to move vehicle
FORBID an unlicensed person to drive vehicle
FORBID a person operating a service from driving
DIRECT a person to stop driving
What is section 114 of the land transport act
Can pull over a vehicle, demand name, address, DOB, occupation contact number
What is section 115 of the land transport act
Forbid a vehicle off the road
What is section 118 of the land transport act
Demand details from owner/ hirer if any offence has happened where the driver of the vehicle has not been identified. Owner has 14 days to say it wasn’t them if it wasn’t.
What is section 119 of the land transport act
Power of entry in to address if you have followed a driver you believe needs an EBA test completed

Power to get a vehicle off the road
FORBID person to drive
ALL keys to be surrendered
RENDER the vehicle immobile

How do demerit points work?
Once you get 100 you get your license disqualified.
After 2 years you get the lost demerits back.
NZTA issue notice first and then they serve it
What does a green sticker mean?
Car is defective. More minor issues such as cracked windscreen, bald tyres etc
What does a pink sticker mean?
Car is unsafe. Ordered off road until the fix is complete. Might be major chassis rust etc
What are the procedures for EBA testing when someone refuses to undertake test?
Ask for a passive test Ask for breathe screening (if needed) Evidential screening Warn for failing to accompany Arrest for failing to accompany. If all other steps are denied
What are the blood and breath limits for adults in an EBA test?
250 breath or 50 blood for fine only
OR
400 breath or 80 blood have to go to court
What are the blood and breath limits for under 20s in an EBA test?
Zero tolerance
Up to 150 OR 30 blood is a fine
Over 150 or 30 is court
How long should you suspend someone from driving following a DUI under 650?
12 hours
How long should you give someone to opt in for blood tests after failing a DUI?
10 minutes but 12 to be safe
