What is a round table conference?
A meeting that takes place between the parties to the dispute and their existing solicitors.
What is a RTC a form of?
Private mediation
What is discussed at RTM’s?
Discussions about ‘settlement offers’ and are done on a without ‘ admissions basis’ and cannot be used in court at a later date, except in limited circumstances eg: to support an application for costs or where evidence led in court is likely to mislead the court, unless that evidence of an offer/discussion is led to correct or qualify the evidence pursuant to s131(2)g of the Evidence Act (1995).
How do RTD work?
The solicitor for one of the parties invites the other party to participate in the RTD. This usually occurs after the solicitors have already been communicating for a period and after some financial disclosure has been provided.
Where does the RTD take place?
At the office of one of the parties legal representative.
Do the parties negotiate face to face?
Sometimes the parties sit in separate rooms and their solicitor carry instructions and negotiate back and forth.
Who are the practitioners?
They are the solicitors who have been retained by each party to the dispute.
What are the features of the RTC?
They are in a lot of ways a form of collaboration, however parties do not enter into a Participation Agreement and practitioners are not prevented from continuing to act for their clients where one party commences court proceedings.
