Role of Mags: Flashcards
Pretrial:
100% criminal cases start in the Mags court with an Early Administrative Hearing.
Deal with: bail, funding and legal representation.
defendant then enters their plea.
guilty: sentenced
not guilty: scheduled for trial.
Either way offences:
mode of trial hearing decides which court (crown/mags) will hear the trial.
Trial:
97% criminal trials are in the Mags court.
MAgs listen to prosecutions opening speeches, and hear evidence from witnesses.
defence will intro their case 2nd and examine their witnesses.
once case concludes, Mags go into a private place to discuss their decision (g/ng). SURE BEYOND REASONABLE DOUBT.
IF return a guilty verdict, they will move the sentencing,
sentence/appeal:
max custodial sentence is 12 months.
sentencing powers: unlimited fines and community sentences.
Mags can also hear appeals in crown court sitting w a judge.
civil work:
Mags do a small amount of civil work.
decide on licenses like alcohol.
deal w the non-payment of council tax, issue arrest and search warrants.
Also work in the youth court: 10-17 yr olds. require special training.
