Section 8 Theft Act 1968
A person commits robbery if he/she steals and immediately before or at the time of doing so, and in order to do so uses force on any person or puts or seeks to put any person in fear of being then and there subjected to force.
Mens rea
Had the mens rea for theft:
Dishonestly
With intention of permanently depriving the other of it
Intended to use force to steal
Actus Reus
Had the actus reus of theft
Force or putting or seeking to put any person in fear of force
Assault with intent to rob
No appropriation of property
Offence of assault with intent to rob- must prove intent.
S.8(2) Theft Act 1968- Maximum sentence life imprisonment
