Robbery is an Indictment Only offence
What are the points to prove for Robbery?
> Steals
Immediately before/at the time of doing so
In order to do so
Uses force on a person or put/seek to put
person in fear of immediate force
What offence needs to be proved for a Robbery offence to substantiated?
The offence of Theft must be proved before a Robbery can be substantiated
No theft = No robbery!
When must force or the threat of force be used?
Immediately before or during
If force is used used to escape, is Robbery committed!
No. Force can not be used to make good an escape
a) If the suspect threatens ‘A’ in order to cause ‘B’ fear and steal a phone is an offence of Robbery committed?
b) If the suspect uses force against ‘A’ by grabbing him in a headlock in order to cause ‘B’ fear and steal a phone is an offence of Robbery committed?
a) No! ‘B’ can not fear for another person
b) Yes! As immediate force was used on any person
If suspect say’s to ‘A’ “GIVE ME YOUR MONEY OR ILL STAB YOU UP AT THE END OF THE DAY!”
Has a Robbery occurred?
No as the threat of force is not immediate!
If suspect says to ‘A’ “GIVE ME YOUR PHONE OR ILL STAB YOU” and ‘A’ hands the phone over.
Has a Robbery occurred?
Yes, as the threat of violence was immediate!
If ‘A’ was in a fight with ‘B’ and ‘A’ punched ‘B’ knocking him to the floor and in doing so, the wallet belonging to ‘B’ fell out his pocket and ‘A’ took it.
Has a Robbery occurred?
No. This would be Assault and Theft because the fight was not intended for the robbery
