What is the definition of Robbery?
A crime where a person steals and immediately before, or at the time of doing so, they use force on any person or seek to put any person in fear of using force.
What must there be?
There must be completed theft or there will be no offence of burglary.
What happened in the case of R v Waters?
Stole her friends phone but said she would give it back if she got her friends to speak to the D - no complete theft.
There must be force or a threat of force - how is this measured?
The amount of force is small - R v Clouden D did not physically touch the V when taking the women’s shopping bag.
What does ‘seek to put a person on fear of force’ mean?
Threatening words ‘I have a knife’ or threatening gestures such as waving a knife in front of a V face.
What happened in the case of R v DPP?
No need to show he feared violence but taking his wallet shows the D sought to put V in fear.
Explain Force must be immediately used before or after the time of theft.
The force must be used to steal, if not it will not be robbery.
What happened in the case of R v Lockley?
Pushed past the security guard when caught shoplifting beer.
