What is a Mechanically Propelled Vehicle?
Any vehicle powered mechanically (diesel, petrol, steam, electric, hydrogen…)
Not pedal cycles (including electrically assisted ones)
What are the Driver limits for Alcohol?
- 35μg (micrograms)per 100ml of breath
- 80mgper 100ml of blood
- 107mgper 100ml or urine
What is Section 4 of the Road Traffic Act 1988?
Driving, or being in charge, when under influence of drink or drugs. Drive / Attempt drive / In Charge Mechanically Propelled Vehicle On Road or Public Place When unfit through drink or drugs
What is Section 5 of the Road Traffic Act 1988?
Drives / Attempts to drive / Is in charge of
Mechanically Propelled Vehicle
Motor vehicle (intend or adapt for use on the road)
On road or public place
Having drunk so much alcohol
To be over the limit for breath/blood/urine.
What is Section 6 of the Road Traffic Act 1988
Any constable may require, who reasonably suspects:
Person is/has been/attempting to drive Motor Vehicle with alcohol in their body, which is still present
OR they had committed a moving traffic offence
OR was a driver in an RTC.
May require a preliminary breath test.
Constable in Uniform conducts (any PC for RTCs)
Time limit for Breath test?
20 minutes from last drink
5 mins from last cigarette
What is Section 165A of the RTA 1988?
Power to seize vehicles driven without licence or insurance
Outline Section 163 of RTA 1988
A person driving
a mechanically propelled vehicle or pedal cycle
on a road.
Shall STOP on being required by a constable in UNIFORM
offence if fail to stop.
Outline Section 164 RTA 1988
Where a person is driving a motor vehicle on a road.
Where a constable has reasonable cause to believe/accident/offence has occurred.
May require from the driver their driving license, name and address of licence holder
date of issue and authority who issued.
No License - power to ask date of birth.
Outline Section 165 RTA 1988
Same as section 164 with addition of driving in OTHER PUBLIC PLACE.
What is Section 4 of PACE 1984.
Road Checks. Conduct a vehicle search to see if its carrying:
1) a person who has committed an indictable offence
2) or about to
3) or witness to indictable off
4) a person unlawfully at large.

Duty to exchange details and report RTC
Owing to the presence of a MPV on a ROAD or PuBLUC PLACE, an ACCIDENT occurs in which: Damage is caused to fixed/ permanent property, ANOTHER vehicle (inc a bike), to an animal other than one in a vehicle or trailer or INJURY caused to ANY person. The driver of the MPV must stop and give on request by any person reasonably requiring them, Name and Address, N&A of owner, VRM and insurance if PI. MUST report to Police station within 24hrs if details not exchanged on scene.

Outline Section 154 RTA
Any person who has damaged property must produce their certificate of insurance to any person reasonably requiring at the scene. If not produced at scene they have 7 days to report to a police station
