What is a right?
Entitlements that people have by legal or moral authority
What is a responsibility?
Legal or moral OBLIGATIONS that a person may have to another person, group etc
How are Rights and responsibilities interrelated?
When someone has a responsibility to another person, the other person has a corresponding right to be treated in a particular way.
What is an example of a right covered by statute law?
The right to not be discriminated against
What is an example of a right covered by common law?
In tort law, if someone buys something they have the right to enjoy it
What counties have a bill of rights?
US UK AND NZ
What is a bill of rights?
A statement of basic human rights and privelleges
Why doesn’t Australia have a bill of rights?
The authors of the constitution believe our rights would be protected by statute.
Eg. The right to trial by jury
How do we determine the difference between legal and moral rights?
Moral rights come from ethics
Legal comes from statute or the body of decisions constituting common law
Why are their conflicts between rights and responsibilities?
State interference with personal liberties
