As spelled out in section 5(2), academic freedom shall be enjoyed in all institutions of higher learning, that is, at the tertiary level.

As defined in Section 13 of Batas Pambansa BIg. 232, academic freedom is the right granted to institutions of higher learning to determine on academic grounds who shall be admitted to study, who may teach, and what the subjects of study and research shall be.
