Is revival available in Florida and what does it mean?

A

In Florida, no revival!

If Testator’s valid second will revoked his first will, the first will remains revoked even if the Testator later revokes the second will. Fla. Stat. § 732.508.

In other states, if you can show the intent to revive, then can revive the former will

What happens to the codicils when a Testator revokes a will?

A

If T revokes a will he also revokes any and all codicils to that will. Fla. Stat. § 732.509.

What happens to the will when a Testator revokes the codicils?

A

If T revokes a codicil, the statute presumes that he intended to reinstate the will as it was before the codicil. Fla. Stat. § 732.508(2)
