Marbury v. Madison

A

Facts: John Adams named John Marbury as a federal judge and Congress did not send him through and then Marbury sued for his place as a federal judge.
Decision: Unanimously, the section of the Judiciary Act that Marbury was using to get SCOTUS to force James Madison to deliver the commissions was deemed unconstitutional.
Significance: Established judicial review, or the power to deem a law unconstitutional.

McCulloch v. Maryland

A

Facts: The Second Bank of the US was established. Maryland put a tax on the Bank, and McCulloch decided not to pay the tax, Maryland decided that the bank was unconstitutional and the govt. couldn’t charter a bank anyways.
Decision: Unanimously, the court said it was fine and also could not be taxed.
Significance: Gave the federal government power to use the enumerated and proper clause.

Schenck v. United States

A

Facts: Socialist guy named Charles Schenck distributes pamphlets to young men calling on them to resist their draft into WWI and was arrested for violating the Espionage Act of 1917. Schenck sued and claimed it was a violation of his First Amendment right to free speech.
Decision: SCOTUS unanimously decided that it was not a violation of his free speech because his speech posed a “clear and present danger”.
Significance: Established the clear and present danger test.
