Conciliation - suggests

A

A process of dispute resolution involving the assistance of an independent third party with the aim of enabling the parties to reach a decision.

Conciliator: The independent third party, who helps the parties reach an agreement that ends the dispute between them.

  • Listens to both sides of the dispute and makes suggestions about appropriate ways of resolving the matter.

A

purposes and types of remedies

A

purpose remedy
- to restore the injured party to the position they were in before the wrong occurred, as much as possible.

Types
DAMAGES
- amount of money to be paid by the defendant to the plaintiff.
- purpose: compensate the plaintiff for loss or injury suffered.
- specific = loss of wages
- general = pain and suffering
-aggravated = humiliation and insult

INJUNCTIONS
- attempts to restore the plaintiff to the position they were in prior to the loss or harm suffered.
- restrictive = stopping someone from doing something.
- mandatory = when a person wishes to compel someone to do a particular act.
