Relevance
evidence is admissible if it is relevant, and no other exclusionary rule applies to bar it.
Evidence is relevant if it has any tendency to make the existence of any material fact more or less probable than it would have been without the evidence
- Irrelevant evidence is not admissible
Probative value
the probative value of relevant evidence is the degree to which evidence makes a material fact more or less likely
The balancing test
a court may exclude relevant evidence if the evidence probative value is substantially outweighed by (1) undue consumption of time (2) substantially confusing the issues (3) substantial danger of undue prejudice (4) substantially misleading the jury
