Habit evidence
A
Habit describes a person’s regular response to a specific set of circumstances. Evidence of habit, if relevant, is admissible to prove that the conduct of a person was in conformity with that habit.

A
Evidence is relevant if it has any tendency to make the existence of any fact that is of consequence to the determination of the action more or less probable than it would be without the evidence. Relevant evidence can be excluded by a judge if its probative value is substantially outweighed by the danger of unfair prejudice, confusion of the issues, waste of time, or misleading the jury.
