What have the Law Commission suggested?

In the Draft Criminal Liability (Mental Element) Bill 1978 proposed that Parliament should state whether it is creating a strict liability offence or not. This prevent some of the confusion and inconsistency of judicial decisions.

In the Criminal Liability in Regulatory Contexts it considered that parliament should state in acts whether an offence was one of SI. It was felt this would make the law clearer. It also suggested that there could be a defence of due diligence in all cases.
