Facts: French student living with Grandma in UK was denied for a student loan on the basis that he was not settled in the UK.

The court repeated that educational policy now lay within the scope of the treaty

Therefore a union citizen who enjoyed a right of residence in the UK under Article 20 TFEU had a right to equal treatment under article 18 in respect of student grants or loans.
