RDA Flashcards
Racial Discrimiantion Act
The Racial Discrimination Act (1975) makes it unlawful to treat someone unfairly based on their race, ethnic origin or skin colour.
Protects
It protects individuals in various areas of public life, including employment, education, accommodation, services, and accessing public places.
Qantas
Mr Gama, a man of Indian and Fijian descent was employed as an engineer at Qantas Airways. He was discriminated against and subjected to harassment from co-workers and supervisors.
Federal Court
The Federal Court found Qantas liable for not taking reasonable steps to prevent the unfair treatment of employees. This case established that employers can be held accountable for workplace discrimination, and how the Racial Discrimination Act can protect Australia citizens.
60%
Despite this around 60% of people believe that racism is still a significant problem in Australia.
Hindmarsh
A group of Aboriginal women opposed the construction of a bridge to Hindmarsh Island in South Australia. However, the Australian Government passed the Hindmarsh Island Bridge Act (1997) which excluded the bridge project from the Racial Discrimination Act.
Prevent
This meant the Aboriginal people couldn’t use the Act to prevent the bridge’s construction, showing how Parliament could undermine the Act if it suited political or economic interests.
