- Must owe more that $16,750
- if fewer than 12 creditors - One or more owed $16,750 unsecured
- if 12 or more creditors - three owed $16,750 unsecured
- Farms and charities may not be forced into involuntary*
What is preferential payment in bankruptcy?
- Made for the benefit of the creditor for existing debt
- Within 90 days prior to filing
- Within 1 year for insiders
- receiving more that creditor would have if it went through bankruptcy
What are the three basic categories of claimants paid in order?
Secured claimants
Priority Claimants
General creditors who filed their claim on time
*If there is not enough to pay all creditors at particular level, creditors share pro rata
