R4 M1 - Circular 230

Question 1

In a divorce situation you can file jointly if the divorce is not finalized. The practitioner needs that approval of both parties. If not the practitioner is in violation of circular 230.

Circular 230 –> The practitioner may change publish fee information but would have to wait at least 30 calendar days to change her fee that was published.

Question 3

There are three conditions in which you are allowed to charge a contingent fee when it comes to:

1. IRS examination or audit
2. Claim for credit or refund of interest and / or penalties
3. A judicial proceeding arising under the IRC
