Because it cannot be determined as to how long the convict will serve sentence because after served the minimum, he may be released on parole.
There are four mitigating circumstances and one aggravating circumstance. Under the rules on offsetting, there remain three mitigating circumstances. The judge therefore lowered the penalty by one degree and applied the penalty in the medium period. Is the judge correct?
No, because the penalty should not be lowered by one degree considering that there is an aggravating circumstance present.
