What are the three types of groups that can claim
Primary, secondary, and rescuer
What must a primary victim prove?
They have a medically recognized condition + Injury to them was foreseeable.
What is a primary Victim?
Victims who suffer psychiatric injury as a result of being directly affected by the negligent act or fearing for their own safety
What is a secondary victim?
Suffer injury as a result of fearing for the safety of others
What are the 2 main control mechanisms for secondary victims?
Having close ties of love and affection + Perceiving the event with own unaided senses or witnessing immediate aftermath
What are the other 3 three less important control mechanisms of secondary victims?
- The injury was caused suddenly
- The claimant is of normal fortitude
- injury to the claimant was foreseeable.
Rescuers can only claim if?
Can Claim if they themselves were in danger
