Who is a duty of care owed to?
A
Anyone who has a link to the action e.g a driver has a duty of care to other road users and pedestrians.

A recognised medical condition. Not simply human emotions e.g grief and sorrow.

What are the types of victums?
A
There are primary and secondary victims.

Primary victims
A
- a participant in the accident.
- someone involved directly in the accident which suffers following what he/she experiences
- those with reasonable belief they are in danger
- rescuers placing themselves in danger or reasonable belief of danger.

Secondary victims
A
- Not a direct participant
- a witness to the accident or someone who arrives at the scene in the aftermath
- fear of injury to themselves or by injury to others.
