At common law, counsel for the Accused must ensure the continued functioning of the trial system. Conduct of Defence also binds the Accused as Defence is responsible for the running of trials and hearings.

Legislatively, Defence counsel have duties to disclose any expert or alibi evidence in both the lower and higher courts.
