Procedure for Marriage Settlement
1) modification made before marriage
2) in writing
3) registered in the local civil registry
4) registered in the registry of properties
5) executed before marriage
Property relations of the spouses shall be governed by Philippines, regardless of the place of the celebration of the marriage and their residence, except:
1) spouses both foreigners
2) extrinsic validity of contracts affecting property not situated in the Philippines and exceuted in the country where the property is located
3) with respect to the extrinsic validity of contracts entered in the Philippines but affecting property situated in a foreign country whose laws require different formalities for its extrinsic validity
Grounds for Revocation of donation Propter Nuptias
1) marriage was not celebrated
2) marriage was declared void ab initio
3) marriage was declared void and the donee spouse acted in bad faith
4) legal separation and the donee spouse acted in bad faith
5) Donation subject to resolutory condition and such condition has been met
6) Act of ingratitude under the law by the donee spouse
7) the spouse did not acquire the consent of the parents, guardian, as required by law
Exclusive Properties under CPG
1) That which is brought to the marriage as his or her own
2) that which acquires during the marriage by gratuitous title
3) that which is acquired by right of redemption, barter, or exchange with property belonging to only one of the spouses
4) that which is purchased with exclusive money of the wife or of the husband
