What is the basic definition of robbery?
A person is guilty of robbery if he steal and immediately before or at the time, in order to steal, he uses force or threatens force on any person.
What is the actus reus for robbery?
Appropriate Property Belonging to Another Force / Threat of force Immediately before or at the time In order to steal ON any person
What is the mens reus for robbery?
Dishonesty
Intention of permanently depriving
What does the case of Robinson tell us?
If there is no theft, there is no robbery.
What does the case, corcoran v Anderton tell us?
A touch is sufficient.
What happened in Clouden?
D wrenched a women’s shopping bag. Was found guilty as he touched property that didn’t belong to him.
What happened in Dawson v James?
D1 nudged a man in order for D2 to take is wallet. Both were found guilty of robbery.
What happens is Bentham?
D went to rob V. In doing so D puts his fingers in his pocket to imamate a gun, as a result V gave over the money.
Why is Bentham significant?
No force needs to be applied, a threat of force is sufficient.
What is meant by the term “On any person”?
Force applied on any person means it does not matter that force is applied or threatened, only that it directed at somebody.
What does S.8 require in regards to using force/ threat of?
Requires that use or force or threat of must be in order to steal.
Why is the term “immediately before or at the time” crucial?
Force used or threatened after the theft has been completed does not constitute to a robbery conviction, it falls under two separate convictions.
