Applied to CA criminal proceeding under prop 8 all relevant evidence is admissible subject to the balancing test under 352 and some other exception.

Confrontation clause
A
Under the 6th amendment confrontation clause, every person should enjoy the right of not to be accused in a criminal trial. The confrontation clause can be satisfied by one or two ways
1. Produce the witness
2. If the witness is unavailable the defendant had a previous opportunity to cross-examine the witness.
