What is the aim of the guidelines?
A
To mitigate the harshness of the common law rules on part-payment of debt.

What is the first guideline?
A
Clear and unequivocal - promissor will only lose ability to enforce a right if it is clear they promised to give it up.

A
Promisee has altered his position - acted in a way that would make it inequitable for the promissor to break the promise.

A
Inequitable to resile - D&C Builders v Rees (knew builders had no choice).

A
Only suspensory - only temporary. CLPT v High Trees.

A
