NRA
N – Necessary (Why now? What’s changed? Can you articulate your actions were necessary?);
R – Risk Effective (Chances of actions being successful? What are consequences if don’t act?); and
A - Acceptable (Ethically? Legally?).
What is positive Action
an action, such as the breaching of a window or door, specifically for the purpose of communicating and/or locating a subject within the premises, prior to invoking this Procedure. This action is to determine that the subject is physically in the premises and has been advised to surrender and has refused. Positive Action will only be authorized after consultation with the RTOC, a Critical Incident Commander or a Critical Incident Command qualified member of the ERU.

Ancillary Powers Doctrine
applies where (1) police are executing a particular statutory or common law police duty – such as, to protect life or to protect the public; (2) the police conduct was reasonable and necessary to fulfill that duty. There is no statutory authority in under the MHA
RTA- when does it not apply
-living accommodation intended to be provided to the travelling or vacationing public or occupied for a seasonal or temporary period in a hotel, motel or motor hotel, resort, lodge, tourist camp, cottage or cabin establishment, inn, campground, trailer park, tourist home, bed and breakfast vacation establishment or vacation home.
-living accommodation whose occupant or occupants are required to share a bathroom or kitchen facility with the owner, the owner’s spouse, child or parent or the spouse’s child or parent, and where the owner, spouse, child or parent lives in the building in which the living accommodation is located
