A Testament as to the Testator’s wish.
Will
A decedent who died without a nuncapative , holographic or written will. The law of intestacy applies.
Intestate
The legal process to authenticate a will , to dismiss the apocryphal will , and to govern the administration and distribution of estate
Probate
One of sound mind who makes a will or testament anent the distribution and administration of his or her estate.
Testator
The judicially appointed person to oversee an estate in the event of the decendent’s intestacy. He or she died without a will.
Administrator
The person named in the authentic will or insurance party. He may be the equitable named person under a Trust , where the legal owner is the Trustee.
Beneficiary
The deceased person’s property in its entirety.
Estate
A person named in the will to administer , disburse and dispense the estate.
Executor
One has the obligation to act in the best interest of a 3rd party.
Fiduciary duty
A person entitled by law to inherit the estate of a deceased person .
Heirs
A legal document that adumbrates the person’s wishes in the events of physical or mental incapacity. It addresses such legal issue as Stand By Guardianship which is discrete from Adoption . An action taken during the preparer’s life.
Living Will
Latin for ‘ You get something for having given something.’
Quid Pro Quo
Nuncapative Will
A calligraphic or hand written will.
Holographic Will
