Personal Representative
appointed to carry out the estate administration
Executor
personal representative who is named in the will
Administrator
personal representative who is NOT names in the will.
Primary probate jurisdiction
domicile of decedent at time of death
Appointment of PR
any person who has capacity to contract may serve. A PR will be assigned as administrator if no one is named in will.
Powers and Duties of a PR
1) give notice to devisees
2) discover and collect assets
3) manage assets during administration
4) pay expenses of administration
5) distribute property
Compensation of PR
governed by statute or reasonable compensation
Creditors Claims
PR must notify creditors of the estate. Creditors collect after expenses, allowances, secured claims and judgements.
Abatement
reducing gifts when estate assets are not sufficient to pay all.
Abatement order if not specified
1) property passing by intestacy
2) residuary estate
3) general legacies
4) specific bequests and devises
Exoneration of Liens
UPC + majority = liens on specifically devised property are NOT exonerated.
Ambiguous Will
T's intent then if not clear on intent 1) favor those who would take intestate 2) avoids intestacy 3) consistent with "plan" of disposition 4) every portion given effect 5) later in time.
Will substitutes
include life insurance, JT’s TbE, inter vivos trusts, deeds, contracts, gifts. Can avoid taxes and eliminate cost of probate
