ADMINISTRATION OF ESTATE
Management and distribution of a deceased person’s estate.
ADMINISTRATOR (male)
When someone dies intestate the administrator to collect money due to the deceased and wind up the estate.
ADMINISTRATRIX (female)
The female version of administrator who collects money due to the deceased and wind up the estate.
ASSETS
The total property of a person, firm or organisation.
ATTESTATION
The signature of the witness to a documents execution.
ATTESTATION CLAUSE
Last clause of a Will stating that a document has been signed in the presence of the witness.
BENEFICIARY
A person entitled to benefit under the Will. They must not witness the Will.
BEQUEATH
To leave personal property to others in a Will.
BEQUEST
A gift in a Will of property, other than land.
CERTIFIED COPY
A copy of an original deed or document signed and certified as true.
CHATTELS
Any property other than freehold land.
CODICIL
A document which amends or adds to an existing Will.
COMMISSIONER FOR OATHS
Person appointed to administer oaths to persons making affidavits.
DECEASED
A person who has died.
DEVISE
A gift of land and goods contained in a Will.
DOMICILE
The country where a person has their permanent home.
DYING WITHOUT ISSUE
To die without leaving children, grandchildren or other descendants.
ESTATE
The total possessions of a person when they die. Includes property, money and possessions.
EXECUTED
The signing of a Will to administer the estate.
EXECUTOR
Person appointed in a Will to administer the estate off the deceased.
EXECUTRIX
The female version of an executor to administer the estate in a Will of the deceased.
HEIR
A person who inherits an estate.
HM REVENUE & CUSTOMS
The governing body which administers taxation.
INHERITANCE
The assets which descend to the heir on the death of the owner.
ISSUE
Offspring- children, grandchildren or other blood descendants.
LEGACY
A gift of personal property.
LETTERS OF ADMINISTRATION
Document issued by the court authorising someone to deal with the estate of an intestate.
PECUNIARY LEGACY
A gift of money in a Will.
PREDECEASED
To die before someone else.
PROBATE
Document confirming an executor has the right to administer the deceased estate.
RESIDUE
The remaining assets of an estate after payment of debts, for example funeral costs.
REVOKE
Cancel or withdraw.
SPECIFIC LEGACY
Leaving a specific item in a Will to a names beneficiary.
TESTATOR/TESTATRIX
Person who makes a Will.
TRUSTEE
A person appointed in a Will to administer trust.
VESTED INTEREST
A claim under a Will.
WILL
Declaration by a testator concerning the disposition of property after death.
