Fair Credit Reporting Act
Doesn’t allow the federal government from accessing a persons finance records without telling them.
Right to Financial Privacy Act
The option that must be given to financial institution customers under the GLBA, which takes away the institutions right to share personal data.
Opt-out
Passed as an amendment to the Fair Credit Reporting Act, allowing customers to obtain free credit report once each year from each of the three primary consumer credit reporting companies.
Fair and Accurate Credit Transactions Act
Forces those who exposed health information to notify those affected within 60 days of the data breech. Also includes the Health Information Technology for Economic and Clinical Health Act (HITECH) which bans sale of health information, and increases security for patients
The American Recovery and Reinvestment Act
Act that regulates the interception of telephone and oral communications. It requires law enforcement to get a warrant.
Title III of the Omnibus Crime Control and Safe Streets act. Or the wiretap act.
Act that allows surveillance for foreign intelligence purposes. Requires approval from a judge if a U.S. person is involved.
Foreign Intelligence Surveillance Act (FISA)
The three main issues that the Electronic Communications Privacy Act (ECPA) deals with.
1 - The protection of communications while in transfer from sender to receiver.
2 - The protection of communications held in electronic storage
3 - The prohibition of devices from recording electronic communication information without a search warrant.
Who can issue a National Security Letter? what does it do?
The FBI director. It compels holders of personal records to turn them over.
Device that records electronic impulses to identify the numbers dialed for outgoing calls
Pen register
Device that records the originating number of incoming calls for a particular phone number.
Trap and Trace
Amended both Wiretap Act and ECPA. required telecommunication industries to build tools into it’s products to help federal investigators eavesdrop.
Communications Assistance for Law Enforcement Act (CALEA)
Act that loosened restrictions on NSLs. It allowed the FBI to issue one only on the basis that information is needed for an ongoing investigation.
USA PATRIOT Act
Provision that prohibits NSL recipients from informing anyone that the government has requested records.
NSL gag provision
Allows spying on individuals not affiliated with a particular terrorist organization. (Lone wolves)
Foreign Intelligence Surveillance Act Amendments Act
Granted NSA expanded authority to collect, without court-approved warrants, international communications.
