Q

With the aid of a diagram chart the evolution of privacy in the Irish constitution ?

A

Mcgee – Privacy in the marital bedroom – sued the state – Laws overturned

Kennedy x Arnold – can sue all citizens – sued the state – compensation (privacy grounded in the Christian and Democratic nature of the state not absolute)

Herrity case – all citizens (not absolute) – sued husband and newspaper – compensation 90k

Norris – gay couples (can be interfered with for the common good, public interest, health, morality etc. – sued the state to overturn law making homosexuality legal – lost in Ireland appealed to European courts where he succeeded and then Ireland eventually overturned the law

Now on par with Europe they have taken away privacy from place and attached it to the person

As well as this the Irish courts have always have remedy’s that’s not under privacy’s; harassment etc.
