Negligence Standard
- Owed a duty of care

Duty of Parent to Supervise
Must supervise and ensure child does not act in grossly negligent or reckless fashion
Contributory negligence
Complete bar to recovery
- CN was substantial cause of harm
- CN occurred during the same act or omission as D’s
Tort Liability of Child
<7 generally not liable
7-13 rebuttable presumed not liable
Relevant comparison is children of like age, knowledge, understanding, and experience
Assumption of Risk
Complete bar to recovery
- knowingly (full appreciation of scope) &
- voluntarily accepted the risk (no coercion)
Eminent Domain/Condemnation
Cities, towns, and counties may exercise
