Fairness
Refers to the ability of individuals to receive impartial treatment before the legal system, without discrimination, fear or favour. Fairness refers to the provisions of unbiased treatment for all, therefore eliminating actual bias or apprehension of bias.
How the legal system upholds fairness:
• Presumption of innocence
•Burden and standard of proof
•The right to a trail by jury
Access
Refers to the idea that all individuals should have the ability to be provided with opportunities and resources as a means for individuals to resolve their dispute. It means that all indictable should revive access to a range of institutions for assistance and services, and understand the law (legal rights and terms) regardless of any physical, mental or financial burdens they may face.
How the legal system upholds ACCESS
• Victorian legal aid/ Community legal centres
• Translators
• The right to be informed about proceedings
Equality
Refers to the notion that all individuals are treated equal in status, rights and opportunity. All individuals before the law must be treated in a manner free from discrimination, based on cultural differences, SES, and other personal characteristics
How the legal system upholds equality ;
•Access to legal rep for all (VLA,CLC)
• the strict rule of procedures apply to both parties
