- courts and personnel should not show bias
- the case must be decided based on facts not opinions

A
- allows for public scrutiny
- allows for people to be held accountable for their actions
- allows for people to be involved in processes, and ensures justice is done
- example: public hearings, court judgements available to public

participation
A
- people should ALL be able to participate in the justice system
- opportunity to know the case put against them
- use of a lawyer
- tried without unreasonable delay

same treatment
A
- formal equality (people are treated the same way regardless of circumstances)
- same processes will apply in every case and for every party
- ensures everyone gets the same opportunity and the same level of support

A
- substantive equality - one size fits all wont always work, and sometimes special measures will have to be taken so people don’t suffer disadvantages due to their circumstances
- example: interpreters, changes to court processes
