What are the elements of Conspiracy under common law?
1) the defendant entered an agreement with another to accomplish an unlawful purpose
2) The defendant had the specific intent to accomplish that purpose and
3) In most jurisdictions, at least one conspirator committed an overt act in furtherance of the agreement.
What is the difference between the MPC and CL view of Conspiracy?
Under the MPC/Majority view, only one person needs to intent to enter into the agreement.
Under CL view, two or more persons must intend to enter the agreement.
In order to charge multiple individuals of a single conspiracy, must they all know of the participation of the other individuals in the scheme?
