Q

Presumptions/burdens of proof in jury instructions

A

The Due Process Clause of the Fourteenth Amendment requires in all criminal cases that the state prove guilt beyond a reasonable doubt. A mandatory presumption or a presumption that shifts the burden of proof tot the defendant violates the Fourteenth Amendment’s requirement that the state prove every element of a crime beyond a reasonable doubt.
