what are the powers of presidency
expressed, delegate, inherent powers
expressed powers
power to make treaties, grant pardons, nominate judges and other public officials; cannot be revoked by constitution
delegate powers
powers given to the president by congress, congress enhances the power and importance of presidency; e.g. delegate the executive branch the power to determine the best means of improving a specific issue; can be taken away by the congress
inherent powers
prerogative, not specified by consitution but stems from ‘rights, duties and obligations of the presidency,’ usually related to times of war or national emergency
military expressed powers
president is commander in chief, highest military office;
- head of nation’s intelligence hierarchy
- use of force within the US: limited by state legislature that must request federal troops before president can send them into the state to provide public order
judicial expressed powers
article 2, sec 2: provides power to grant reprieves and pardons for offenses against the US, except in case of impeachment
diplomatic expressed powers
art 2, sec 3, the power to receive ambassadors and othe rpublic ministers
executive expressed powers
can appoint federal judges (art.2, sec 2),
legislative expressed powers
art 1, sec 7 & art. 2 sec 3: president has the power to participate authoritatively in the legislative process; veto, veto pocket
executive agreement
nature of a treat, contract between 2 counteies without requiring a 2/3 of approval by senate; carry out commitment made in treaties
executive priviledge
claim that confidential communications between president and close adviseers should not revealed without the president’s consent
veto
assigned by article 1, section 7: the power to reject acts of congress, makes the president the most important legislative leader; no bill vetoed by president can become law unless both the house and senate override veto by 2/3 vote
pocket veto
a veto that occurs automatically when congress adjourns during 10 days that a president has to approve a bill and the president takes no action
line-item veto
president’s power to strike specific spending items from approapriations bills passed by congress, unless 2/3 of house and senate reenacts them
war powers resolution
1973, congress power to declare war, required president to inform congress of any planned military campaign and stipulated that forces must be withdrawn within 60 days in the absence of congressional authorization
