What is a leading question and are they permitted?
A leading question is one that suggests the answer within the question.
Generally, they are not permitted.
In what instances are leading questions permitted?
1) Necessary to develop witnesses’ testimony
2) Witness has difficulty due to age or physical/mental condition
3) Witness is adverse/hostile
4) Witness is opposing part
5) Witness is associated with opposing party
What is a question that assumes facts not in evidence and are they permitted?
A question that assumes as true facts that have not yet been established at not permitted.
Attorney must introduce relevant evidence and law proper foundation.
What is a compound question?
A compound question requires answers to multiple questions and is not permitted.
