A

I was not personally involved in this process as it is the clients futures however, I am aware that it is where tenants / residents have to contribute towards the works.

Stage 1 is the notice of intention
Stage 2 is the notification of the estimates
Stage 3 is the notification of the award and contract

One of your pre contract duties was to understand the clients brief. How did you do this?

A

We had various design team meetings earlier on in the RIBA stages. This assisted in outlining the clients requirements for the project and understanding their business.

This led to the key drivers to be met.

You say you advised on the procurement route for this project. So why did you end up choosing a traditional over a design and build.

A

Traditional was chosen due to a number of reasons:

First and foremost the requirement of cost certainty and quality control.

Also, due to the market conditions and the time of procurement, contractors were not willing to accept design risk.

How come you chose an intermediate form of contract over a standard form of contract?

A

I felt that the work required did not amount to a level of complexity that needed a standard building contract however, therefore, the intermediate was the best choice for a more cut down version of the standard building contract and a more complex version than the minor works

What are the differences between the JCT SBC and the JCT IC?

A

In the IC:

  1. All subcontractors are domestic and the responsibility of the main contractor
  2. Values which are around the £1million mark

In the SBC:

  1. Sub contractors can be appointed with the written permission of the architect or CA
  2. Can be used in conjunction with a PCSA
  3. Values in excess of a million

The collateral warranty was between the engineer who designed the capping and the client

Did you discuss with tenderer 2 about reducing the programme?

A

After instruction from the client, I contacted tenderer 2 to reduce the programme in line with our benchmark rates however they were fixed and adamant it was not possible.

So what made you confident that tenderer 1 could deliver within the 51 weeks.

A
  1. The scheme was benchmarked against similar schemes we had worked on
  2. The programme submitted by tenderer 1 was detailed by the day, therefore underwent due diligence
