State Article 6 of the Civil Code of the Philippines?
Rights may be waived, unless the waiver is contrary to law, public policy, morals or good customs, or prejudicial to a third person with a right recognized by law.
What is a waiver?
It is an intentional relinquishment of a known right.
What are the requisites of a valid waiver?
(1) Person making the waiver must have the right in waiving
(2) He must have the capacity to make the waiver
(3) The waiver must be made clear and unequivocal manner
(4) Waiver must not be contrary to the law, public order, public policy, morals or good customs or is prejudicial to third person
(5) If required, formalities must be complied with.
