Potential Consequences of PR Violation
Public Reprimand
Private Reprimand / Private Admonition
Suspension
Disbarment
Public Reprimand
Formal, everyone knows you messed up.
Private Reprimand
Formally reprimanded, but the public doesn’t know. You should tell your employer but don’t have to tell clients.
Suspension
No law practice for a time
Disbarment
It’s over
but you could still practice in a new jurisdiction. You’d still have to apply to practice in that new state though and they’re gonna ask if you’ve ever been disbarred.
Disciplinary Process
1) Complaint Reported
2) Investigation (if you get a letter, you should RESPOND TO IT)
3) Determination of Probable Cause
4) Formal Hearing
5) Appeal
What to do if you’ve been suspended?
1) Must tell all your clients you’ve been suspended and can’t rep them for some time.
2) Must tell employer - you might have to retake MPRE or take CLE classes.
3) Can’t file a brief, sign your name on stuff, basically limited to whatever you could do during a summer clerkship.
