What are ‘Premises’? (Section 23)
Any place, including any vehicle; vessel; aircraft or hovercraft; any offshore installation; any renewable energy installation and any tent or movable structure.
What is CLAD
C - Concealed
L - Lost
A - Altered
D - Destroyed
What is Section 17?
Arresting to prevent serious harm and injury.
Such as:
- Arrest a child/young person who’s escaped from secure accommodation/detention
- Recapture someone unlawfully at large & liable to be detained
Recapture someone unlawfully at large whom you are pursuing.
What are the main powers of entry and search?
Section 17, Section 18 and Section 32.

18/32: Searching Premises and Property
Section 32?
Section 32: Premises, not people
- Searched after an arrest for an ‘indictable’ offence
= Search premises where the suspect was at the time of their arrest OR where they were immediately prior to their arrest
Section 18?
Section 18:
- To search premises after arrest
- Generally where the arrest has taken place away from their address
- Premises occupied or controlled by suspect
- Reasonable grounds to suspect evidence of the offence/connected or similar ‘indictable’ offence
