What does section 24(2) state?
If a constable has reasonable grounds for suspecting that an offence has been committed then he can arrest the person without a warrant
What does section 24(3) state?
If an offence has been committed an officer can attest without a warrant -
A) anyone who’s guilty of the offence
B) anyone who he suspects with reasonable grounds to be guilty of the offence
What does section24(1) state?
A constable may arrest a person without a warrant when -
A) the person is about to commit an offence
B) a person who is in the act of committing an offence
C) if there’s reasonable grounds that the person is about to commit an offence
D) if there’s reasonable grounds to suspect that the person is committing an offence
Why can a necessity test be used?
- to prevent physical injury
- loss or damage to property
- to allow effective investigation of the offence
- to find out the names/address of the people involved
What must police do when arresting a person?
Tell them they’re under arrest

Why the arrest is necessary and give caution
Identify themselves if not in uniform to make the arrest lawful
What does section 46(a) state?
That a police may arrest without a warrant when a person who was released on bail fails to attend the station at a set time
Can the police search the arrested person?
Yes for anything that might be used to escape or evidence of the offence
Search in public = removing outer coat jacket and gloves
What does section 24(A) state?
That under certain circumstances ordinary people can arrest without a warrant
What’s the reasons for a citizen making the arrest?
Prevents the offender from taking off before police come, causing physical injury to himself or someone else
